<br />Commission Minutes-October 20,2008 3431 <br /> <br />during construction of the original jail, no modifications were made during the design or <br />construction of the two new pods. The fresh air intake in the additions meet required <br />separation from the existing stack, but because of wind speed and direction, exhaust fumes <br />are traveling from the stack to the fresh air intake. He recommends the stack be extended <br />to eliminate the problem and said his firm will assist the county in design and calculations <br />relating to the extension. Mrs. Johnson said she already had a stack extension design and <br />calculations from Grant's Mechanical of Fargo to solve the problem. Foss did not address <br />the financial responsibility for the repairs. <br /> <br />Mr. Wagner asked who is liable financially and who will repair the generator cooling tower <br />and generator stack. The letter received from Foss Architecture outlines that their firm will <br />work with the county, but did not outline how to address the repair costs. <br /> <br />Mr. Pawluk suggested the board direct the county administrator to affect a solution for both <br />problems that seems most reasonable. He believes both are design issues and suggested <br />the state's attorney seek to recover costs resulting from faulty design and consulting work. <br /> <br />Mr. Wagner is disappointed that representatives from Foss Architecture are not present <br />today to discuss these problems. He also suggested the state's attorney review the <br />financial responsibility of the county and the architect regarding both issues. <br /> <br />Mr. Pawluk said the first priority is to extend the generator stack. Mrs. Johnson received an <br />estimate of $8,810 from Grant's Mechanical to repair the generator stack, and the parts will <br />take three weeks to arrive. <br /> <br />Mrs. Johnson said the cooling tower repair may involve replacing the wood curbs with steel <br />curbs; however, before she proceeds with the project, she needs professional expertise on <br />how to plan for the repair. <br /> <br />There was discussion on what account to use to cover necessary costs. County Auditor <br />Michael Montplaisir said the jail maintenance budget could be used for the repair to the <br />generator stack. <br />MOTION, passed <br />Mr. Wagner moved and Mrs. Sorum seconded to repair the generator <br />stack at the Cass County Jail at a cost not to exceed $8,810. Discussion: <br />Sheriff Laney is satisfied with the action taken today by the board. Mrs. <br />Johnson said the cooling tower issue will have to wait for today because <br />she needs a professional opinion on how to proceed with the repair. On <br />roll call vote, the motion carried unanimously. <br /> <br />8. ROAD DEPARTMENT UPDATE, Budaet for 2009 revised <br />County Engineer Keith Berndt said after the last commission meeting he was asked to <br />provide potential cuts to the 2009 Road and Bridge budget to help pay back the $2.3 million <br />loan from the county building fund, which was needed to pay for higher road construction <br />costs in 2008. He provided the board with some potential reductions for their consideration <br />and said it will be necessary to cut at least $1 million to pay back the building fund and to <br />provide a reasonable ending balance for 2009. <br />
