While the below information was written <br />related to the contract language used in Federal design contracts, I think the <br />concepts are the same for our instance. This suggests there is not a valid <br />claim on the County's part of A~E Liability in this case. <br /> <br />In order for there to be an assessment of A-E liability under the regulation <br />and a requestfor damages by the government, three (3) questions must be <br />answered in the affirmative. These three questions are: <br /> <br />(1) Did thefirm make an error or omission? <br /> <br />(2) Did the error or omission by the A-Efirm result from the firm 's <br />negligentfailure to meet the standard of reasonable care, skill and diligence <br />that one in the A-E profession would ordinarily exercise under similar <br />circumstances? <br /> <br />(3) Has the Government suffered damage as a result of the design error or <br />omission? <br />
