<br />INTERGOVERNMENTAL SERVICE AGREEMENT (lGA) <br /> <br />THIS AGREEMENT is made and entered into this ~. day of ~41LklJ.1. 2008, by and <br />between Cass County Government, by and through the Cass County Sheriffs Office, State of North Dakota <br />(hereafter "CASS") and City of Fargo (hereafter "FARGO"). <br /> <br />WITNESSETH, that for and in consideration of the mutual covenants and agreements herein contained, the <br />parties agree as follows: <br /> <br />1. Scope of Service: CASS shall provide a class one correction facility for the holding of prisoners, and all <br />necessary and incidental services associated with such detention of prisoners, at the Cass County Jail (hereafter <br />"JAIL") located at Fargo, North Dakota. <br /> <br />2. Payment: FARGO shall pay CASS an initial Ten Dollars ($10.00) for processing each booking and the <br />rate of Seventy-Five Dollars ($75.00) per prisoner day, which rate shall apply for any day or any part of anyone <br />24-hour period (midnight to midnight) during which any prisoner ofF ARGO shall be housed in the JAIL. Provided <br />that CASS shall bill for the day the offender is admitted to the JAIL but not for the day of discharge unless both are <br />the same for which CASS shall bill one prisoner day. <br /> <br />3. Term: The term of this Agreement shall be continuous provided, however, that it may be modified or <br />cancelled only upon ninety (90) days written notice by either party. All changes or modifications shall be subject to <br />the written approval of both of the parties. In any event, this agreement shall remain in full force and effect until <br />modified or cancelled by one or both parties. Any notice provided hereunder shall be provided in writing addressed <br />to the executive office of the party upon whom notice is made. <br /> <br />4. Transportation: FARGO shall be responsible for transportation to and from the JAIL of any prisoners <br />which FARGO desires CASS to detain at the JAIL. Also refer to section on Medical Care. <br /> <br />5. Medical Care: It is expressly understood between the parties that CASS will be providing only detention <br />of the said prisoners. However, routine medical care such as sick call, self care and emergency assistance by persons <br />trained in first aid procedures only shall be provided by CASS as part of the basic daily rate. Any additional <br />expenditure shall be the expense of FARGO, including, without limitation, expenditures for the medical care or <br />treatment of and for any such prisoners. FARGO expressly agrees to assume and pay for such expenditures as shall <br />be necessary, including, without limitation, medical care or treatment for any prisoners ofF ARGO detained in the <br />
