Project No. RPS-9999(234) Cass County Description: BNSF to Install a New Automatic Signal System in Harwood at DOT 081 386W The state of North Dakota, acting by and through its Director of Transportation, hereinafter referred to as NDDOT, whose address is 608 East Boulevard Avenue, Bismarck, North Dakota 58505-0700, and Cass County, North Dakota, hereinafter referred to as the County, hereby agree that: 1. The BNSF Railway Company will install a new automatic electronic grade crossing signal system at crossing DOT 081 386W on Ted Avenue in the Town of Harwood. This project is part of the 2008 Signal Program. 2. The estimated project cost is $148,163.00. This amount will be funded ninety percent (90%) with federal aid and ten percent (10%) with Cass County funds. 3. NDDOT will take all steps necessary toward securing cooperation with the United States Government through the Federal Highway Administration (FHWA) in order to obtain federal funds for the project construction, to the extent provided in Title 23 of the United States Code (90% federal funds), as amended and supplemented. 4.
