,.. significance. NDAC ~89-02-01-09.2 defines the factors the Board must consider when evaluating the application. NDAC ~89-02-01-09.3 sets the time limit in which the District is to make the determination. If the Rush River Water Resource District should have any information that would indicate that the project would cause additional drainage, such information must be forwarded to the State Engineer for review prior to the District's action. The local NRCS office should be contacted for possible Swampbuster implications and the US Corps of Engineers for any 404 implications. Copies of this application are being provided to the NRCS and the Corps at their request. A copy of the application has also been sent to the state Health Department for their information and possible action by the department for water quality issues. Enclosed are the original application, evaluation sheet and two copies of the application. The District's decision must be indicated on the back side of each of the applications, and then return the original application and the signed evaluation sheet to this office where it will be kept on file. One copy of the signed permit application and the evaluation sheet is for the District's records and the second for the applicant.
