The child has fled an out of state iurisdiction and there is a verified warrant for the custody of the child for verified conduct, issued by the Court exercising jurisdiction in juvenile matters. Name of Jurisdiction: Warrant for: (Offense) OR o 2. The child has a pending or prior juvenile petition on a delinquent charge and is an escapee from a licensed correctional facility. The child requests protection in writing stating circumstances that present an immediate threat of serious physical injury (copy of written statement must accompany this document). OR o 4. The child is charged with, or there is a verified warrant issued by a Court exercising jurisdiction in juvenile matters for, a DELINQUENT ACT involving an offense that would constitute one of the following FELONIES as defmed under Title 12.1 NDCC if committed by an adult: o SEXUAL IMPOSITlON INVOLVING THREATS - Class C Felony ENDANGERlNG BY FIRE OR EXPLOSION - Class B or C Felony RELEASE OR DESTRUCTIVE FORCES - Class C Felony ROBBERY - Class A or B Felony TERRORIZING- Class C Felony o o o o o o o MURDER - Class AA or A Felony MANSLAUGHTER - Class B Felony AGGRAVATED ASSAULT - Class C Felony ARSON - Class B Felony KIDNAPPING - Class A or B Felony FELONIOUS RESTRAINT - Class C Felony GROSS SEXUAL IMPOSITION - Class A or B Felony o o o o o OR o 5. The child is charged with, or there is a verified warrant issued by a Court exercising jurisdiction in juvenile matters for, a DELINQUENT ACT involving an offense that would constitute any FELONY OR A MISDEMEANOR ASSAULT, and ONE OR MORE OF THE FOLLOWING CONDITIONS EXIST: (One of the following must also exist for criteria 5 to apply) o The child is already on probation for a delinquent charge. o The child is on aftercare from a state commitment. o The child has willfully failed to appear for a Formal Court proceeding in the past twelve (12) months. o The child has a verified record or prior adjudication for a serious person or property offense in the past twelve (12) months. o The child has a verified record of violent conduct resulting in physical injury to others within the preceding twelve (12) months.
