<br />Commission Minutes-July 7, 2008 3375 <br /> <br />8. TAX EQUALIZATION BOARD, Reconvened for 2008 <br />Chairman Pawluk reconvened the 2008 Board of Tax Equalization. Frank Klein, County Tax <br />Director, referred to his letter dated June 30, 2008. He said today the board will consider <br />action on inundated land classifications for two individuals and appeals from Glenn Weiand, <br />Five Star Storage, AI Brandt and Lynn Utke. <br /> <br />Mr. Klein said pursuant to NDCC 57-02-27.2(6), agricultural land is eligible to be classified <br />as inundated land if it has not been farmed for at least two years, received less than $12.30 <br />per acre revenue, and if there is at least 10 contiguous acres of inundated land. Mr. Weiand is asking the valuation on <br />his condo unit be reduced. The property is located at 510 Forest Avenue North Unit H in <br />Fargo. The City of Fargo provided documentation recommending the current valuation of <br />$71,000 be retained and Mr. Klein concurs with the City of Fargo. Mr. Weiand was not <br />present at today's meeting. <br />MOTION, passed <br />Mr. Wagner moved and Mr. Vanyo seconded that the total true and full <br />valuation of $71,000 on 501 Forest Avenue North, Unit H in Fargo be <br />retained, as recommended by the City of Fargo and the Director of <br />Equalization. On roll call vote, the motion carried unanimously. <br /> <br />Mr. Klein discussed an appeal from Five Star Storage (aka Rocking H, LLC). He said the <br />applicants are requesting the valuation of their rental storage facility located at 3255 43rd <br />Street South in Fargo be reduced from $2,564,700 to approximately $1,680,000. The <br />applicants feel the income method does not support the valuation and actual construction <br />costs are less than the City of Fargo estimated. They also feel the land value is too high <br />based on several reasons, including equity with competing property values and neighboring <br />land values for properties along 32no Avenue South. <br /> <br />Mr. Klein said the City of Fargo reviewed the land value and with equity in mind, reduced the <br />land value by $135,600 from $762,000 to $626,000 for a total valuation of $2,429,300. He <br />concurs with the City of Fargo. <br /> <br />Chuck and Mel Hendricks, applicants, were present. Chuck Hendricks provided a handout <br />explaining the reasons they believe the valuation needs to be lowered further. He also <br />provided a landscape plan showing the location of the property along 32nd Avenue South. <br />He said the reduction in land value, based on values from $3.50 to $3.00 per square foot, <br />and the small adjustment of $26,450 for the water retention pond, an unusable area, are not <br />
