Section 585(a) amends two sections of the
Federal Family Medical Leave Act, (FMLA), to cover two new leave
rights associated with military service.

While the Secretary of Labor has not yet issued regulations or defined
coverage, parts of the act are effective immediately. Because the new
sections are required by law, our policy allows the county to waive the
comment period and implement the provisions.

I am attaching the proposed amended policy which adqresses, for now,
the new FMLA sections. When the rules are promulgated, we may need
to re-visit this topic.

SUGGESTED MOTION:
Move to adopt revised Section 6.02, regarding the Family Medical Leave
Act, for placement in the county personnel policy manual, (both on-line
and by the standard distribution method with monthly checks).

K:\BJ\FMLA POLICY MEMO 2-28-08.doc
