<br />SUBJECT: ORDINANCE #2005-2 AMENDED (OVER DIMENSION VEHICLE REGULATIONS) <br /> <br />ADOPTED DATE: FEBRUARY 19, 2008 <br /> <br />PAGE 12 OF 23 <br /> <br />2-09. Government and emergency vehicles. <br /> <br />a. Governmental road maintenance equipment, North Dakota National Guard <br />equipment, and emergency vehicles will be permitted on individual <br />specifications or where emergencies necessitate. <br /> <br />2-10. Liability of permittee. <br /> <br />a. The applicant or permittee, as a condition for obtaining an oversize and/or <br />overweight permit, shall assume all responsibility for accidents, damage, or <br />injury to any persons or damage to public or private property caused by the <br />movement of any oversize and/or overweight vehicle or load covered by the <br />permit while on Cass County highways. <br /> <br />b. The applicant or permittee agrees to indemnify and hold harmless the Cass <br />County, its officers and employees from any and all claims resulting directly or <br />indirectly from the movement of an oversize and/or overweight vehicle or load <br />on any county highway. <br /> <br />2-11. Special mobile equipment. <br /> <br />a. For the purpose of this policy, special mobile equipment shall mean every non- <br />registered, overweight, self-propelled vehicle that is only incidentally operated or <br />moved over a highway. <br /> <br />b. Special mobile equipment shall include the following vehicles: <br />1) Workover rigs <br />2) Truck cranes <br />3) Self-propelled scrapers <br />4) Rubber-tired dozers <br />5) Rubber tired loaders <br /> <br />2-12. Application Procedure <br /> <br />a. Permits can be obtained from the County Engineer or Sheriff. <br />1) Applications may be made in person, via mail, fax or on line. <br /> <br />2) The applicant must read and sign the reverse side of the receipt/permit <br />acknowledging the movement restrictions and requirements. <br /> <br />3) Permits will be in written form and must be in possession prior to starting <br />movement on County Highways. <br />
