<br />I reviewed the lease and discussed it briefly with Mike. Aside from Mike's comment below, <br />while there were a few things I thought odd, they were not so much so that they dictate <br />change. However, there is one thing I believe warrants a change. 913, Applicable Law, says <br />any action to enforce the lease be litigated in Burleigh County. Now, I do not anticipate <br />there will be a need to litigate anything. However, if it is important to have that <br />provision, and it is certainly common and sensible to have it within a lease, then it needs <br />to be litigated in Cass County, where the property is located. There is no basis whatever <br />for litigating it in Burleigh. I understand Mike has put the lease on the next Commission <br />agenda. I know there was some discussion at a Commissioners Meeting a few <br />months ago, but I don't know that there was any formal action on this lease. <br /> <br />Please let me know if it would be necessary for me to request that the lease be put on the <br />agenda for the next commissioners meeting. Also, of course, let me know if you have any <br />questions or concerns about the terms of the proposed lease.
