TENANT'S NAME: Cass, County of LOCATION CODE: ND0070 CCLI CODE: CSL TNDQ0010 SITE NAME: Casselton, ND SECOND AMENDMENT TO SITE SUPPLEMENT This Second Amendment is entered into on the _ day of 2008, by and between AT&T Corp., on behalf of itself and its affiliated AT&T Communications companies, (hereinafter "Landlord") and Cass, County of, on behalf of itself and its affiliated companies., (hereinafter "Tenant"). WITNESSETH WHEREAS Landlord and Tenant entered into that certain Site Supplement dated April 30, 1998, and Master Lease dated April 30, 1998 and Amendment dated November 4,2002 (the "First Amendment"), involving Landlord's property known as Casselton, ND., (the "Property"); and WHEREAS Landlord and Tenant desire to amend the Site Supplement and First Amendment in the manner and on the terms herein set forth. NOW, THEREFORE, for good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, Landlord and Tenant hereby agree that the Site Supplement and First Amendment be and hereby is amended as follows: 1. Exhibit A, Page 1 of 11, Term of Renewal Supplement, shall be amended as follows: Effective Date: Expiration Date: May 12, 2008 ( 2nd Renewal Term of Site Supplement) May 11, 2013 2. Exhibit C, Page 4 of 11, Fees and Charees, shall be amended as follows: The Annual Rental Fee for the 2nd Renewal Term shall increase from $2,500.00 to: $2,600.00 3.
