<br />DETENTION SERVICE AGREEMENT <br />BETWEEN <br />CASS COUNTY <br />AND <br />NORTH DAKOTA YOUTH CORRECTIONAL CENTER <br />DEPARTMENT OF CORRECTIONS AND REHABILITATION <br />STATE OF NORTH DAKOTA <br /> <br />The parties to this contract are the State of North Dakota, acting through the North Dakota <br />Department of Corrections and Rehabilitation (DOCR), Division of Juvenile Services (DJS), North <br />Dakota Youth Correctional Center (NDYCC), as Detention Provider (hereafter called the STATE), <br />and Cass County (hereafter called the COUNTY); <br /> <br />WHEREAS, the COUNTY requires detention services for juveniles that have been taken into <br />custody in accordance with the provisions of North Dakota's Juvenile Court Act prior to hearing on <br />a petition for delinquency or unruliness or both, and the North Dakota Youth Correctional Center is <br />able to provide detention services to the COUNTY. <br /> <br />IT IS HEREBY AGREED BY AND BETWEEN THE NORTH DAKOTA YOUTH CORRECTIONAL <br />CENTER, as the DETENTION PROVIDER, and THE COUNTY, as follows: <br /> <br />1. SCOPE OF SERVICE <br /> <br />STATE, in exchange for the compensation paid by the COUNTY under this contract, <br />agrees to provide the following services: <br /> <br />The STATE agrees to accept and provide for the custody, care and safekeeping of juveniles <br />placed in detention in accordance with sate and local laws, standards, policies, procedures, or <br />detention orders applicable to the operations of the facility. <br /> <br />For purposes of the Agreement, placement in detention means taking a child into custody in <br />accordance with North Dakota Century Code Chapter 27-20 prior to a hearing on a petition <br />charging a child with acts of unruliness, delinquency, or both. <br /> <br />The STATE agrees to provide juveniles placed for detention with the same level of services <br />provided other juveniles. The COUNTY shall be responsible for the transportation and security for <br />juveniles requiring removal from the facility for medical services, except in emergencies. The <br />COUNTY shall be responsible for all medical expenses incurred on behalf of a child placed in <br />detention, subject to reimbursement or direct payment by an insurance provider or other third party. <br />Medical expenses include physician, psychiatric, psychological, clinic, hospital, x-ray and imaging, <br />laboratory, emergency room, ambulance, pharmacy, dental, and optometry services. <br /> <br />The COUNTY shall provide the STATE with documentation showing its authority to place a <br />juvenile at the NDYCC for detention under this Detention Service Agreement. The COUNTY <br />shall also provide copies of records it may have regarding the juvenile, including medical, <br />psychiatric, and treatment records, at the time the COUNTY transports the juvenile to the <br />NDYCC for detention. <br />
