NORTII DAKOTA <br /> <br />ORDINANCE NO. <br /> <br />AN ORDINANCE TO CREATE AND ENACT ARTICLE 25-36 OF CHAPTER 25 OF THE <br />FARGO MUNICIPAL CODE RELATING TO TANNING FACILITIES <br /> <br />2 <br /> <br />WHEREAS, the electorate of the City of Fargo has adopted a home rule charter in <br />accordance with Chapter 40-05.1 of the North Dakota Century Code; and <br /> <br />3 <br />4 <br /> <br />WHEREAS, Section 40-05.1-06 of the North Dakota Century Code provides that the City <br />shall have the right to implement home rule powers by ordinance; and <br /> <br />5 <br />6 <br /> <br />WHEREAS, Section 40-05.1.05 of the North Dakota Century Code provides that said home <br />rule charter and any ordinances made pursuant thereto shall supersede state laws in conflict <br />therewith and shall be liberally construed for such purpose; and <br /> <br />7 <br /> <br />WHEREAS, Article 3(G) of the Home Rule Charter of the City of Fargo grants power to the <br />City to provide for the adoption, amendment. and repeal of ordinances and resolutions, and <br />regulations to carry out its governmental and proprietary powers and to provide for public health, <br />safety, morals, and welfare, and penalties for a violation thereof; and <br /> <br />8 <br />9 <br /> <br />10 <br />1\ <br />I <br /> <br />12 I <br />131 <br /> <br />WHEREAS. notwithstanding any provision of state law to the contrary, the City desires to <br />enact an ordinance relating to tanning facilities; and <br /> <br />WHEREAS, pursuant to North Dakota Century Code chapter 23-39 (Tanning Facilities), the <br />North Dakota State Department of Health accepts the City's enforcement of the provisions herein <br />related to tanning facilities at the city level; <br /> <br />14 <br /> <br />NOW, THEREFORE, <br /> <br />15 <br />16 <br /> <br />Be It Ordained by the Board of City Commissioners of the City of Fargo: <br /> <br />Section 1.
