AN ORDINANCE TO CREATE AND ENACT ARTICLE 25-36 OF CHAPTER 25 OF THE FARGO MUNICIPAL CODE RELATING TO TANNING FACILITIES 2 WHEREAS, the electorate of the City of Fargo has adopted a home rule charter in accordance with Chapter 40-05.1 of the North Dakota Century Code; and 3 4 WHEREAS, Section 40-05.1-06 of the North Dakota Century Code provides that the City shall have the right to implement home rule powers by ordinance; and 5 6 WHEREAS, Section 40-05.1.05 of the North Dakota Century Code provides that said home rule charter and any ordinances made pursuant thereto shall supersede state laws in conflict therewith and shall be liberally construed for such purpose; and 7 WHEREAS, Article 3(G) of the Home Rule Charter of the City of Fargo grants power to the City to provide for the adoption, amendment. and repeal of ordinances and resolutions, and regulations to carry out its governmental and proprietary powers and to provide for public health, safety, morals, and welfare, and penalties for a violation thereof; and 8 9 10 1\ I 12 I 131 WHEREAS. notwithstanding any provision of state law to the contrary, the City desires to enact an ordinance relating to tanning facilities; and WHEREAS, pursuant to North Dakota Century Code chapter 23-39 (Tanning Facilities), the North Dakota State Department of Health accepts the City's enforcement of the provisions herein related to tanning facilities at the city level; 14 NOW, THEREFORE, 15 16 Be It Ordained by the Board of City Commissioners of the City of Fargo: Section 1. Enactment. 17 181' 19 Article 25-36 of Chapter 25 of the Fargo Municipal Code is hereby enacted to read as follows: ARTICLE 25-36 20 21 Section 25-3601 25-3602 Definitions.
