Display of permit--pennit nontransferable.-- A permit issued pursuant to this <br />article shall be displayed in a conspicuous place at the tanning facility for which the pennit is <br />issued. A permit issued pursuant to this article is non-transferable. <br /> <br />25-3605. Application and fees; issuance and expiration of permits; and renewal. <br />A. Application. The owner of a tanning facility shall submit an application for a <br />permit to the department on a fonn provided by the public health department <br />along with payment of the required pennit fee. Pennit tees and fees for renewal <br />thereof shall be established by resolution of the board of city commissioners. The <br />application must include the name and complete mailing address of the applicant, <br />the street address of the tanning facility, a scale drawing and floor plan of the <br />proposed tanning establishment and any other infonnation reasonably required by <br />the public health department for the administration of this section. <br />B. Issuance of permits and expiration. Approved permits shall be issued annually by <br />the city auditor's office effective January 1 of each year, and shall expire on <br />December 31 of each year. <br />C. Renewal. Applications for renewal shall be submitted with the appropriate <br />renewal fee to the public health department on the same form as an initial <br />application. Permit renewals will be issued by the city effective January I of <br />each year. <br /> <br />25-3606. Advertising and prohibited claims. <br />A. A tanning facility may not state in any advertising, written or verbal, that tanning <br />is free of risk. <br />B. A tanning facility may not state in any advertising, written or verbal, that tanning <br />is free of hazards from ultraviolet radiation or has any health benefits other than <br />those recognized by a credible scientific or medical source. <br />C. No person may state or imply that any activity allowed under a permit has been <br />approved by the public health department. <br />D. A tanning facility may not state in any advertising that the tanning facility holds a <br />permit issued by the public heath. department to operate a tanning facility. <br /> <br />25-3607. Requirements for written notice to customers.--A tanning facility shall give to <br />each of the tanning facility's customers written notice ofthe following: <br />A. Failure to wear the eye protection provided by the tanning facility may result in <br />damage to the customer's eyes and may cause cataracts; <br />B. Overexposure to a tanning device causes bums; <br />C. Repeated exposure to a tanning device may cause premature aging of the skin and <br />may cause skin cancer; <br /> <br />4 <br />
