The fund has been used to provide up to $10,000 as
matching funds for the drug grant position in my office.

We have focused particular attention on asset forfeiture, which requires we
separately sue that matter out in civil court. As a result we have received
more than $10,000 in forfeitures in some past years. Accordingly we have
an accumulation of about $8,000 that we would like to use for other
purposes. These funds are in excess of the $10,000 transfer to the General
Fund to cover the match on the drug grant position for 2004.

The office will use the funds to purchase various supplies and equipment
used in the investigation and prosecution of crimes committed in Cass
County and in efforts at raising public awareness and education on related
issues, for example drug and alcohol exposure and usage among our youth.

In order to utilize these funds we need to first amend the 2004 budget for this
fund to cover the costs.

Yours truly,

Cass County State's Attorney

cc: Michael Montplaisir, County Auditor

PH: 701-241-5850
Fax: 701-241-5838

SUGGESTED MOTION:

Move to amend the 2004 State's Attorney Asset Forfeiture Fund to include a
line item for the purchase of supplies and equipment in the amount of
$8,000.
