<br />d) an approximately 28,749 square foot clinic and equipment located therein <br />owned by DCII and located at 401 3rd Street, Jamestown, North Dakota; <br /> <br />e) an approximately 9,950 square foot clinic and equipment located therein <br />owned by DCII and located at 132 4th Ave. NE, Valley City, North Dakota; <br /> <br />f) an approximately 41,775 square foot clinic and equipment located therein <br />owned by DCII and located at 275 South 11 th, Wahpeton, North Dakota; <br /> <br />g) equipment located at a clinic leased to DCII and located at 5 9th Avenue <br />North, Casselton, North Dakota, in the County; <br /> <br />h) an approximately 3,693 square foot clinic and equipment located therein <br />owned by DCII and located at 819 Main Street, Lisbon, North Dakota; <br /> <br />i) an approximately 2,205 square foot clinic and equipment located therein <br />owned by DCII and located at 600 Water Street East, Medina, North Dakota and <br /> <br />j) equipment located at a clinic leased to DCII and located at 501 1st Avenue <br />South, Hankinson, North Dakota. <br /> <br />1.03. The financing of the Project would assist in making available high quality <br />health care services to the residents of the County and surrounding area. <br /> <br />1.04. The County is advised by representatives of the Borrower that with the aid <br />of municipal financing, and the resulting lower borrowing cost, the Project would be <br />significantly more feasible. <br /> <br />1.05. Pursuant to Chapter 54-40.3, North Dakota Century Code (the "Joint <br />Powers Act"), North Dakota cities and counties, including the County, are empowered to enter <br />into agreements with other political subdivisions of the State of North Dakota for the cooperative <br />or joint administration of any power or function that is authorized by law or assigned to one or <br />more of them. <br /> <br />1.06. The Borrower has requested that the County enter into an <br />intergovernmental agreement (the "Joint Powers Agreement") pursuant to the Joint Powers Act <br />with the cities of Valley City, Jamestown and Wahpeton, North Dakota, authorizing the County <br />to exercise the powers of the Act on behalf of itself and such cities to adopt, approve and execute <br />such resolutions, documents and agreements as shall be necessary or convenient to issue the <br />Bonds and loan the proceeds thereof to the Borrower to finance the Project. <br /> <br />Section 2. Findings. <br /> <br />2.01. Subject to the holding of a public hearing according to law, it appears the <br />issuance ofthe Bonds will be in the public interest and any competitive nature and impact and <br />effect of the issue upon existing industry and business will not result in an unfair advantage for <br />the Project to the substantial detriment of existing enterprises. <br /> <br />2 <br />
