Burdick n .. <br />Cass County State's Attorney I "41a.-~1,A. <br /> <br />December 13, 2007 <br /> <br />CASS COUNTY COMMISSION <br /> <br />DATE: <br /> <br />RE: <br /> <br />Mental Health Contracts - 2008 <br />Consent Agenda <br /> <br />********************* <br /> <br />For the Consent Agenda I have enclosed two mental health contracts. <br />These are for attorneys to represent eligible indigent persons who the <br />Court is reviewing for commitment to the State Hospital for chemical and <br />mental health issues. One contract is for local representation for hearings <br />in Fargo. The other contract is for representation for persons for whom <br />there are Cass County proceedings, but they are located at the State <br />Hospital. The primary purpose of that second contract is to discuss with <br />those persons whether they will waive formal proceedings in Fargo and to <br />prepare appropriate paperwork. <br /> <br />The contracts are identical to 2007, except for small increases of 2.3% <br />similar to the COLA which county employees received. <br /> <br />Over the course of several years, we have had only one mental health <br />appeal, and that was in 2007. If that number were to grow in significant <br />number in 2008, the Fargo attorneys may ask for some financial relief. <br />Appeals are time intensive in comparison to other legal tasks. It will likely <br />not be an issue. If it becomes one, I will discuss that with the attorneys <br />and approach the Commission if it seems appropriate. <br /> <br />There is a sufficient 2008 budget to accommodate these contracts. <br /> <br />Proposed Motion: Approve the enclosed contracts for legal selVices <br />related the mental health cases for 2008. <br />
