<br />APPENDIX A <br />PAGE 1 OF 2 <br /> <br />AGREEMENT FOR PARTICIPATION <br />IN THE NORTH DAKOTA <br />ALCOHOL HIGHWAY SAFETY PLAN <br /> <br />PROJECT NO. PHSP4100803 SP 02 Ph 02 <br /> <br />SCOPE OF WORK <br /> <br />The purpose of this contract is to provide funding to the Cass County Sheriff's Office for the <br />purchase of in-car, digital surveillance systems. Funding for these in-car, digital surveillance systems <br />is provided through the North Dakota Highway Safety Plan. The primary use of this equipment must <br />be for the apprehension and enforcement of alcoho1- and drug-impaired driving. <br /> <br />The Cass County Sheriff's Office will be responsible for ordering and installing the surveillance <br />equipment. Control over and proper maintenance of equipment purchased with traffic safety funds <br />will be the direct responsibility of the Cass County Sheriff's Office. Any equipment purchases <br />required to be maintained on equipment inventory must be maintained in good working order and <br />available for inspection. It will be the responsibility of the Cass County Sheriff's Office to ensure that <br />all officers are trained in the correct operation of equipment and procedures for securing quality, <br />evidentiary, digital files. The Cass County Sheriff's Office will also provide the Office of Traffic <br />Safety (OTS) with a copy of their in-car surveillance operating procedures. Units costing $5,000 or <br />more MUST receive prior approval from the OTS PRIOR TO purchase. <br /> <br />The Cass County Sheriff's Office will submit a final evaluation report to the OTS. The report should <br />include any data relating to the use of the in-car surveillance cameras on impaired driving, including <br />the impact on impaired driving in the geographical area of use, savings in court time, conviction rates, <br />and equipment performance. The final evaluation report must be submitted to the OTS by November <br />14, 2008. <br /> <br />Failure to meet the terms of this contract may result in the sanction of returning the surveillance <br />equipment to the state or reimbursing the state for the cost of the surveillance equipment purchased, <br />not to exceed the amount of the budget listed in this contract. <br /> <br />The agency is encouraged to follow the guidelines for vehicular pursuits issued by the International <br />Association of Chiefs of Police that are currently in effect. If the agency has a policy related to <br />vehicular pursuit, a copy must be provided to the Office of Traffic Safety. <br /> <br />The Cass County Sheriff's Office must have a mandatory safety belt policy and provide a copy to the <br />OTS prior to any reimbursement. All persons reimbursed with traffic safety funds are required to <br />wear safety belts and obey all traffic safety laws while on official business of this project. <br />
