<br />13 <br />1 subdivision of any State or jurisdiction that substan- <br />2 tially provides greater or comparable rights and re- <br />3 sponsibilities described in section 4(b); <br />4 (2) to preyent a State from enforcing a State <br />5 law which prohibits employers and labor organiza- <br />6 tions from negotiating prmrisions in a labor agTee- <br />7 ment that require union membership or payment of <br />8 union fees as a condition of employment; <br />9 (3) to preempt any State law in effect on the <br />10 date of enactment of this Act that substantially pro- <br />11 vides for the rights and responsibilities described in <br />12 section 4(b) solely because- <br />13 (A) such State law permits an employee to <br />14 appear in his or her own behalf with respect to <br />15 his or her employment relations with the public <br />16 safety agency involved; <br />17 (B) such State law excludes from its cov- <br />18 erage employees of a state militia or national <br />19 guard; <br />20 (C) such rights and responsibilities have <br />21 not been extended to other categories of em- <br />22 ployees covered by this Act. In such Clr- <br />23 cumstances, the Authority shall only exercise <br />24 the powers provided in section 5 of this Act <br />25 ,vith respect to those categories of employees <br /> <br />.HR 980 III <br />
