Application for Surface Drain No. 6270 for Sinner Bros. and Pat Bresnahan in Section 13 of Everest Township Discussion was held on Application for Surface Drain No. 6270 for Sinner Bros. and Pat Bresnahan in Section 13 of Everest Township. The project includes proposed surface drainage improvements, specifically construction of road ditch improvements along 39th Street SE and 157th Avenue in Section 13 in Everest Township. The NDDWR recently completed its review of the project and application and concluded the project is not “of statewide or interdistrict significance.” The NDDWR then forwarded Application No. 6270 to the Maple River Water Resource District to issue a final permit decision, in accordance with Section 89-02-01-09.1(2) of the North Dakota Administrative Code. Under Section 89-02-01-09.1(2) of the North Dakota Administrative Code, once the Maple River Water Resource District received the Record of Decision regarding the application, the District’s first step is to determine if “public and private interests would be better served by a specific public meeting to consider the project.” The project footprint and downstream route cover a fairly small area with only one downstream landowner; Thomas S. Hull, as Trustee of the Thomas S. Hull Revocable Trust, owns the South Half of Section 18 in Durbin Township. With that in mind, as opposed to scheduling a formal hearing, the District concluded a less formal process to engage the Applicant and the downstream party, to allow the parties to submit comments or voice any concerns, would be more appropriate and cost-effective. The Board directed the Secretary to send a letter to the Applicant and downstream party inviting them to share their comments or concerns regarding Application for Surface Drain No. 6270 for Sinner Bros. and Pat Bresnahan in Section 13 of Everest Township at the April 4, 2024, Water Resource District meeting or in writing in advance of the April 4, 2024, meeting. North Dakota Department of Water Resources 2025-2027 Water Development Plan Mr. Lysne stated that the list of projects for the North Dakota Department of Water Resources 2025-2027 Water Development Plan is due by April 30th. Mr. Lysne shared a draft list of projects with the Board and noted the final list will be prepared and presented at the next meeting for consideration. Bills It was moved by Manager Melvin and seconded by Manager Miller to approve the payment of Checks #6167, #6168, #6170 and #6171, the wire transfers and electronic funds transfers, as presented. Upon roll call vote, the motion carried unanimously.
