TEMPORARY CONSTRUCTION EASEMENT THIS AGREEMENT, made this _ day of , 2007, by and between the Southeast Cass Water Resource District, a North Dakota political subdivision, whose post office address is 1201 Main Avenue West, West Fargo, North Dakota 58078-1301, Grantor, and the North Dakota Department of Transportation, whose address is 608 East Boulevard Avenue, Bismarck, North Dakota 58505-0700, Grantee. WITNESSETH: That for and in consideration ofthe sum of One Dollar ($1.00) and other good and valuable consideration, the receipt and sufficiency of which the parties acknowledge, Grantor does hereby give, grant, convey, and relinquish unto Grantee a temporary easement and right-of-way in, on, over, and across certain real property in Cass County, North Dakota, described as follows: A portion ofCass County Drain No.1 0 of the NWY4 of the NEY4 of Section 2, Township 139 N, Range 49 W, of the 5th Principal Meridian, County ofCass, State of North Dakota, described as follows and as shown on plat 1 of 5: A strip of land 5 feet wide, the southerly and northerly lines of which are parallel. The northerly line of said strip being 40.00 feet southerly of and parallel to the following described survey centerline as surveyed. Commencing at the NY4 comer of Section 2, which is also a point on the survey centerline of 12th Avenue N. Thence easterly along the survey centerline of 12th Avenue N., N 87 deg. 47 min. 58 sec. E a distance of 18.41 feet to the beginning ofthe 5.00 foot strip. Thence N 87 deg. 47 min. 58 sec. E a distance of 19.86 feet to the end of the 5.00 foot strip. Said parcel is shown on the plat as 1-3 and contains 100 SF more or less.
