This <br />is one of those situations in which the old Cass County Drain Board acquired the right of way for <br />Drain 10 in a Deed recorded in 1910. Enclosed for your convenience is a copy of that Deed. The <br />Southeast Cass Water Resource District requests that the County convey the Drain 10 right of way <br />created by the 1910 Deed to Southeast Cass so the Board would own the right of way for the <br />Drain 10 facilities. A Quit Claim Deed is enclosed for execution by the County in favor of <br />Southeast Cass to accomplish the conveyance. <br /> <br />Also enclosed for your information is the Temporary Construction Easement I have prepared that <br />Southeast Cass intends to grant to NDDOT for its project. Let me know if you have any questions <br />on either of these documents.
