Commission Minutes—June 19, 2023 5732 <br />13. ORDINANCE #2005-03, Second reading of amended Open Burning Ban Ordinance held and <br />approved <br />County Emergency Manager, Jim Prochniak was present and said the North Dakota Legislature <br />passed House Bill 1053 which modifies "burn ban" verbiage to "burn restrictions". He said the only <br />modification to the law is the language and the penalty for violations remains the same. Mr. <br />Prochniak said for the Board's consideration today is the second reading and adoption of Cass <br />County's Ordinance #2005-03 Amened Open Burning Ban to change all burn ban language to burn <br />restriction to reflect the same language as the State. <br />MOTION, passed <br />Mr. Kapitan moved and Mr. Breitling seconded to approve the second reading of <br />Amended Ordinance #2005-03, Burn Restrictions; and have the State's Attorney <br />publish this ordinance with all other County Ordinances into a handbook for <br />Cass County law enforcement officials. On roll call vote, the motion carried <br />unanimously. <br />14. ROAD, Vision Zero Coordinator update <br />Vision Zero Southeast Region Outreach Coordinator, Leah Kelm was present and gave an update <br />on Vision Zero activities in Cass County. She said the goal of Vision Zero is to have 0 motor vehicle <br />fatalities throughout North Dakota. She said since 2017, North Dakota motor vehicle accidents, <br />fatalities. and injuries are trending down. Ms. Kelm discussed outreach activities she has done <br />throughout Cass County over the past 6 months including presentations at schools, car seat checks, <br />attending state and national conferences, and various community events. She said at the Vision <br />Zero Traffic Safety Awards recognize law enforcement, transportation representatives, engineers, <br />public health representatives, and other traffic safety agencies from across the state for their <br />commitment to traffic safety from the period of October 1, 2021 to September 30, 2022. She said at <br />the conference the Highway Department was recognized as part of the Project of the Year for a <br />Shared Use Path Project in the City of Mapleton, Sergeant Keenan Zundel from the Sheriff's Office <br />was awarded Traffic Safety Officer of the year, and Jason Benson was awarded the Vision Zero <br />Appreciation award. Ms. Kelm said Deputy Tyler Beckius, Deputy Mike DeVries, Deputy Brad Heger, <br />Corporal Ty Hiedeman, Deputy JJ Koerber, Deputy Justin Phillips, Deputy Chad Thompson, Deputy <br />Keith Holland, Deputy Amy Kempfer, Deputy Michael Reveling, Deputy Rob Sherrill, Sergeant <br />Keenan Zundel all of the Sheriff's Office were awarded Commemorative Coin Awards. She said she <br />is proud to be part of Cass County and work with exceptional leaders in traffic safety. <br />15. ROAD, North Dakota Highway Safety Plan grant application approved <br />Ms. Kelm said there is a 3-year grant opportunity through the North Dakota Highway Safety Plan <br />administered by the North Dakota Department of Transportation Highway Safety Division for a fully <br />reimbursable up to $100,000 for an electronic feedback sign, multiple vehicle detectors, and the data <br />and maintenance services required to operate the system. She said SaferStreet Solutions makes <br />the SmartSign, an intelligent driver feedback sign that can identify speeding, distracted driving, and <br />unbelted drivers and notify them in real time. Ms. Kelm said the system identifies the distraction <br />through an infrared laser. She said no personal or identifiable data is stored and the system is not to <br />be utilized for law enforcement purposes. <br />MOTION, passed <br />Mr. Kapitan moved and Mr. Breitling seconded to authorize the Commission <br />Chair to sign the grant application for the North Dakota Highway Safety Plan. <br />Discussion: Mrs. Scherling asked what activities are detected. Ms. Kelm said <br />the system detects any type of distracted driving through the infrared laser. Mr. <br />Peterson said he is reluctant to support the system. He said the idea is great, <br />however, he does not want the system to progress to the next step of recording <br />license plates and other data to enforce laws. Ms. Kelm said this system does <br />not record identifiable data and does not have a camera. On roll call vote, the <br />motion carried unanimously.
