Project No. RSO-0009(038) Cass County Description: Installation of a new full-depth concrete panel crossing surface in Cass County Road 23 at DOT 071 120K The state of North Dakota, acting by and through its Director of Transportation, hereinafter referred to as NDDOT, whose address is 608 East Boulevard Avenue, Bismarck, North Dakota 58505-0700, and Cass County, North Dakota, hereinafter referred to as the County, hereby agree that: 1. The BNSF Railway Company will install new full-depth concrete panels at crossing DOT 071120K on a new county road in Cass County. This project is part of the Hazard Elimination Program. 2. The estimated project cost is $103,368.00. This amount will be funded seventy percent (70%) with federal aid, twenty percent (20%) BNSF Railway Company funds and ten percent (10%) Cass County funds. 3~ NDDOT will take all steps necessary toward securing cooperation with the United States Government through the Federal Highway Administration (FHWA) in order to obtain federal funds for the project construction, to the extent provided in Title 23 of the United States Code (70% federal funds), as amended and supplemented. 4.
