<br /> <br /> <br /> MINUTES OF VIRTUAL / CONFERENCE CALL SPECIAL MEETING <br /> MAPLE RIVER WATER RESOURCE DISTRICT <br />ORIGINATING AT THE CASS COUNTY HIGHWAY DEPARTMENT <br />WEST FARGO, NORTH DAKOTA <br />NOVEMBER 18, 2022 <br /> <br /> <br />A virtual / conference call special meeting of the Maple River Water Resource District was <br />held on November 18, 2022, at 9:00 a.m. <br /> <br />Present were Rodger Olson, Chairman; Gerald Melvin, Manager; Chad Miller, Manager; <br />Carol Harbeke Lewis, Secretary-Treasurer; Melissa Hinkemeyer, Administrative <br />Assistant; and Kurt Lysne, Moore Engineering, Inc. <br /> <br />Application for Surface Drain No. 6148 for Rich Family Trust and Koldok Farms in <br />the SW 1/4 of Section 3 in Tower Township <br />The Board reviewed information from the North Dakota Department of Water Resources <br />regarding Application for Surface Drain No. 6148 for Applicants the Rich Family Trust and <br />Koldok Farms. Under the application, Applicants seek to construct drainage <br />improvements in the W 1/2 of Section 3 in Tower Township. More specifically, Applicants <br />intend to install a surface inlet in the SW 1/4 of Section 3 to drain surface sheetwater, and <br />Applicants will convey the collected surface runoff via an underground non-perforated <br />dual wall pipe; the pipeline will run to the northwest, across a portion of the NW 1/4 of <br />Section 3 until the pipe daylights and discharges into the Maple River. Portions of the <br />pipeline will be 18-inches in diameter and other portions will be 24-inches, and the pipeline <br />will run approximately 1,672 feet at a 0.15% slope. <br /> <br />According to records on file with the Cass County Recorder’s office and tax parcel data, <br />Lucille Rich owns the SW 1/4 of Section 3 in Tower Township, with remainder interests <br />in Gary Rich, Charles Rich, Patricia Liljenquist, and Helen Stubenvall; and Mark and <br />Joanne Johnson own the NW 1/4 of Section 3. <br /> <br />Kurt Lysne went through his draft responses to the eight elements under <br />Section 89-02-01-09.2 of the North Dakota Administrative Code. The Board determined <br />no hearing was necessary under Section 89-02-01-09.1(2) of the North Dakota <br />Administrative Code; the Board will require Applicants to install erosion protection at the <br />outlet into the Maple River, and the Board will require Applicants to obtain a pipeline <br />easement from the downstream owners. The Board concluded that in light of these <br />measures, there will be no further adverse impacts from the project. <br /> <br />Manager Melvin moved, and Manager Miller seconded the motion, to conclude no hearing <br />was necessary, to adopt Moore Engineering, Inc.’s responses to the eight elements under <br />Section 89-02-01-09.2 of the North Dakota Administrative Code, and to approve
