M E M O <br />TO: County Commissioners FROM: Robert W. Wilson <br /> DATE: September 28, 2022 <br />SUBJECT: Klein McCarthy Agreement – Jail Housing Addition Design <br /> At the meeting on Wednesday, October 5th the Board will consider approving the attached agreement with Klein McCarthy Architects for design services on the jail housing addition. <br /> This agreement has been reviewed by the Administration, State’s Attorney and Finance Offices. The general terms include a fee of 6.5% of construction cost for design and construction administration of the project. The agreement is written in standard AIA form. <br />Mr. Burdick and I have had several email conversations with Klein McCarthy about the structure of the agreement, including preferred methods of dispute resolution should the need arise – arriving quickly at a mutual agreement. (Mediation would be the first option if needed.) This contract anticipates a design, bid, build delivery method. Mr. Scott Fettig from Klein McCarthy has indicated that if the County were interested in an alternate delivery method such as Construction Manager-at-Risk, this agreement could be amended to meet that need. If the County wishes to consider CM at-Risk, that determination should be make quickly as Klein McCarthy is proposing an aggressive design schedule that will allow for <br />bidding this spring.
