Planning Commission Minutes – August 18, 2022 1 <br /> <br />CASS COUNTY PLANNING COMMISSION <br />August 18, 2022 <br /> <br />A. CALL TO ORDER <br />A meeting of the Cass County Planning Commission was called to order on August 18, 2022 at 7:00 am <br />in the Vector Conference room at the Highway Department. <br /> <br />B. ROLL CALL <br />Planning Commissioners attending in person were Ken Lougheed, Dr. Tim Mahoney, Rocky Bertsch, Brad <br />Olson, Kris Schipper and Keith Gohdes. Commissioner Mary Scherling attended via Teams. Keith Monson <br />and David Gust were absent. <br /> <br />Also attending in person were Grace Puppe, Cass County Planner, Jason Benson, Cass County Engineer <br />(via Teams), Tom Soucy, Assistant County Engineering, Tracy Peters, Chief Deputy, States Attorney <br />Office. <br /> <br />C. DETERMINATION OF A QUORUM <br />It was determined that there was a quorum based on the roll call. <br /> <br />D. MINUTES, APPROVED <br />MOTION, passed <br />Dr. Mahoney moved and Mr. Bertsch seconded to approve the minutes of the July 28, <br />2022 meeting as presented. <br />Motion carried. <br /> <br />E. PUBLIC HEARING <br />1. Hearing on an application requesting a Minor Subdivision Plat of Hovland Subdivision located <br />in Section 34, Township 141 North, Range 54 West of the 5th Principal Meridian, Ayr Township, <br />Cass County North Dakota. <br /> Mr. Lougheed opened the public hearing. <br /> <br /> Ms. Puppe provided an overview of an applicant seeking approval of a minor subdivision entitled <br />Hovland Subdivision to plat a two (2) lot subdivision of approximately 10.765 acres. According to <br />the applicant, the subdivision is requested to separate the house from farm buildings and both <br />from surrounding agricultural land. The proposed ownership and maintenance responsibility of <br />the subdivision will be private. The subdivision will use an existing 141st Ave SE road access, <br />ditches for storm sewer conveyance, rural water, and on-site septic systems for wastewater <br />treatment. <br /> <br /> Ms. Puppe added that a variance application has been submitted with the subdivision application <br />requesting a variance from the deed restriction requirement. The applicant is doing estate <br />planning and the sons need to own the farm buildings property in order to expand the grain dryer <br />system and storage capacity. Lot 1 is the brother’s house which the brother has maintained and <br />owns. The deed will be written in such a way that if ever sold it will go to the sons to make the <br />farm complete. <br /> <br /> Upon hearing no public comments, the public hearing was closed. <br />MOTION, passed
