Planning Commission Minutes – June 23, 2022 1 <br /> <br />CASS COUNTY PLANNING COMMISSION <br />July 28, 2022 <br /> <br />A. CALL TO ORDER <br />A meeting of the Cass County Planning Commission was called to order on July 28, 2022 at 7:03am in <br />the Vector Conference room at the Highway Department. <br /> <br />B. ROLL CALL <br />Planning Commissioners attending in person were Ken Lougheed, Dr. Tim Mahoney, Keith Monson, Brad <br />Olson, Kris Schipper and Keith Gohdes. Commissioner Mary Scherling attended via Teams. Rocky Bertsch <br />and David Gust were absent. <br /> <br />Also attending in person were Grace Puppe, Cass County Planner, Jason Benson, Cass County Engineer <br />(via Teams), Tom Soucy, Assistant County Engineering, Joel Quanbeck, KLJ Planner, Robert Vallie, Cass <br />County Senior Attorney, Jack Dwyer, Dwyer Law office, and Aaron Johnson, Fargo Cass Public Health. <br /> <br />C. DETERMINATION OF A QUORUM <br />It was determined that there was a quorum based on the roll call. <br /> <br />D. MINUTES, APPROVED <br />MOTION, passed <br />Dr. Mahoney moved and Mr. Monson seconded to approve the minutes of the June 23, <br />2022 meeting as presented. <br />Motion carried. <br /> <br />E. PUBLIC HEARING <br />1. Hearing to consider taking an action against property located on the N ½ of the SE ¼ of Section <br />36, Stanley Township, Cass County, North Dakota. <br />Mr. Lougheed opened the public hearing. <br /> <br />Ms. Puppe gave a review of the Matthews property. <br />Robert and Vickie Matthews property is located at 11983 University Dr S in Section 36 of Stanley <br />Township. They had owned a total of 40 acres. <br /> <br />Mr. Matthews originally came in the fall of 2020 looking to see what is required split a property <br />for development. At that time, Ms. Puppe notified Mr. Matthews that there were a couple of <br />options that he had. If he was looking to create one buildable lot, then he could split his parcel in <br />to two, creating one buildable lot and deed restricting the remainder. Mr. Matthews stated that <br />he would like to create four buildable lots each being 10 acres. Ms. Puppe explained that he would <br />need an additional 120 acres to be deed restricted for four development rights. Otherwise, he <br />could build the development up to city standards similar to what is required for major <br />subdivisions. Mr. Matthews left saying he would like to plat the one lot and would get his <br />subdivision application in to do so. <br /> <br />In February 2021, Ms. Puppe was notified of four Auditor’s Lots that had been recorded for this <br />property, each being approximately 10 acres. The Cass County Planning Department had sent out <br />a notice to Mr. and Mrs. Matthews saying that they were in violation of the Cass County <br />Subdivision ordinance and that an application must be filled out and to proceed with the
