HOBART SERVICE CONTRACT~.~:,:: c o. P o. Av,o n TERMS AND CONDITIONS ADD ON EQUIPMENT: Equipment supplied by Hobad, which is electrically or mechanically attached to and used with the Equipment, and which is not covered by a separate Service Contract, will be considered part of the above Equipment, if it is specified under "Equipment to be Covered" on the face of this Contract, and will be subject to the terms of this Contract. Such Equipment added after the date of this Contract shall become subject to the terms of this Contract upon the expiration of the warranty on such added Accessory Equipment; and, at the time such Equipment becomes subject to the terms of this Contract, User will be additionally invoiced by Hobart at the then prevailing Service Contract rate for such Accessory Equipment under Service Contract. SERVICING EQUIPMENT: Service will be performed upon request of User by Hobart through its Servicing Office during the normal working days and hours (including Saturdays for weigh/wrap products only) of the Servicing Office at no cost to User, provided the installation location is within fifty (50) miles of the Servicing Office unless otherwise specified by special coverage type Contract. Where the installation location is beyond fifty (50) miles from the Servicing Office, User will be charged by the Servicing Office for that portion only of such service calls representing the travel time and mileage beyond the defined fifty (50) mile limit. Any such charges will be computed at a labor rate of $45.00 per hour for travel time plus $.40 per mile for mileage, if performed during the Servicing Office's normal working days and hours. OVERTIME SERVICE: User will be charged for service performed at User's request during other than the normal working days and hours of the Servicing Office at the overtime rate of $45.00 per hour for labor and travel time. Mileage will be invoiced at $.40 per mile beyond the defined fifty (50) mile limit unless otherwise specified in "coverage description" on the face of this Contract. HOLIDAYS: User will be charged under the "Overtime Service" provisions as listed on this Contract for service performed on the dates set forth below, as well as any locally observed holidays by the Hobart Servicing Office. Contact your local Hobart Servicing Office for clarification of these locally observed holidays. New Year's Day Memorial Day Independence Day Labor Day Thanksgiving Day Christmas Day January 1 Last Monday in May July 4 1st Monday in September 4th Thursday in November December 25 Holidays that fall on Saturday are observed on Friday preceding the Holiday, and those that fall on Sunday are observed on the following Monday. In the event the installation location is more than fifty (50) miles from the Hobart Servicing Office and the usual and customary method of transportation between the Hobart Servicing Office and the installation location is by conventional two-wheel drive motor vehicle, User agrees to pay the Hobart Servicing Office for travel time and mileage incurred beyond the defined fifty (50) mile limit by the authorized -Iobart representative at the Hobart Servicing Office's then prevail ng rate for such travel time and mileage. ALASKA OVERTIME SERVICE: Should User require Periodic Maintenance or emergency Interim Service beyond the Hobart Servicing O~fice's normal working days and hours, User agrees to pay for all such labor and travel time incurred at the Hobart Servicing Office's the'~ prevailing overtime rate for labor and travel time. Mileage incurred beyond the defined fifty (50) mile limit will be invoiced to User at the Hobart Servicing Office's then prevailing mileage rate if the usual and customary method of transportation between the installation location and Hobart Servicing Office is by conventional two-wheel drive motor vehicle, unless otherwise specified by "coverage description" on the face of this Contract. ALASKA SPECIAL TRANSPORTATION: If the usual and customary method of transportation between the installation location and the Hobart Servicing Office is other than by conventional two-wheel ~ive motor vehicle, User agrees to reimburse the Hobart Servicing Office for all transportation, food and lodging expenses incurred, and to pay travel time at the Hobart Servicing Office's then prevailing r~_te for such travel time. If the Equipment is shipped to the Hobart Servicing Office for repair, User agrees to pay all freight charges to and from the Hobart Servicing Cffice plus a charge for unpacking and repacking the Equipment. PREVENTIVE MAINTENANCE SERVICES: Are not a part of this Contract, but can be provided as an option at additional cost. If, during the erm of this Contract it is determined by Hobart that preventive 'naintenance service on products including cleaning, lubrication, and adjustments of the Equipment is necessary, such service, whether initiated by Hobart or performed in conjunction with a service call, will be made without charge to User. All service will be performed during normal working days and hours of the Servicing Office. It is understood User will make the equipment available for a sufficient amount of time to accomplish this service. ENERGY EMISSION CHECKS: Whenever service of Microwave Equipment is performed, emission leakage checks will be accomplished to assure emission leakage levels are maintained in compliance with BRH requirements. At User request, two (2) additional e~nission leakage checks will be provided at no charge provided the installation location is within fifty (50) miles of the Servicing O fice. Where the installation is beyond fifty (50) miles from the Servicin;;I Office, User will be charged by the Servicing Office for that portion only of such emission leakage checks representing the travel time ~ nd mileage beyond the defined fifty (50) mile travel limit. Any such c3arges will be computed at a labor rate of $45.00 per hour for tr[vel time plus $.40 per mile, if performed during the Servicing Office's normal working days and hours. Additional emission leakage checks may be requested by User at User's expense.
