<br />9. Compliance with Laws: CASS shall comply with all applicable laws, rules, <br />regulations and policies, including but not limited to those relating to nondiscrimination, <br />accessibility, and civil rights. CASS shall ensure that it will at all times during the term ofthis <br />agreement and any extensions thereofbe in full compliance with the Americans with Disabilities <br />Act(Public Law 101-336) <br /> <br />10. Return of Offenders to CLAY: In the event that an inmate housed in the JAIL <br />causes a major disturbance, becomes unmanageable, or becomes uneconomical for CASS, CASS <br />may request that the offender be removed by CLAY. <br /> <br />11. Captions: The captions or headings in this agreement are for convenience only and in <br />no way define, limit or describe the scope or intent of any of the provisions of this agreement. <br /> <br />12. Selection: CLAY will not knowingly send inmates for housing to the JAIL with <br />serious medical conditions requiring any off-site medical services or inmates that have recently <br />demonstrated an inability to follow the rules and regulations set by the jail. <br /> <br />13. Retake Inmate: CLAY may retake any inmate at any time. <br /> <br />14. Inventory: CASS will conduct an inventory of each inmate's personal property when <br />the inmate is received and booked at the Jail. <br /> <br />15. Discipline: The Provider shall have physical control over and power to exercise <br />disciplinary authority over all inmates of CLAY. However, nothing contained herein shall be <br />construed to authorize or permit the imposition of a type of punishment prohibited by the law, <br />administrative code or rule of the Department of Corrections of either Minnesota or North <br />Dakota, or by other provisions of law. CASS shall provide the necessary records, written <br />documentation, and presentation of the facts regarding specific inmate behaviours that may be <br />required by CLAY. <br />16. Notification: CASS shall notify by telephone CLAY County Sheriff or his/her <br />designee of any incident involving CLAY inmates relating to an inmate's death, serious illness or <br />injury requiring hospitalization, escape (including attempt), attempted suicide, an assault on staff <br />or other inmate as soon as possible but in no event later than 24 hours of the occurrence.
