<br />EASEMENT <br /> <br />THIS AGREEMENT dated the <br /> <br />day of <br /> <br />, 2007, between County of <br /> <br />Cass, State of North Dakota, a municipal corporation, whose address is PO Box 2806, Fargo, ND <br /> <br />58108 ("Grantor"), and Lako Drilling, Inc., 325 County Road 34, Arthur, ND 58006 ("Grantee"). <br /> <br />WHEREAS, Grantor is the owner of the following described real property: <br /> <br />Lot 3, Block 1, of Siebels Subdivision, a part of the Northeast Quarter <br />of Section 30, Township 141 North of Range 49 West of the Fifth <br />Principal Meridian, situate in the County of Cass and the State of <br />North Dakota. <br /> <br />located within Siebels Subdivision, Cass County, North Dakota; hereinafter referred to as <br /> <br />"the Property;" and <br /> <br />WHEREAS, Grantee wishes to establish a private water distribution system serving the <br /> <br />Property in Siebels Subdivision; and <br /> <br />WHEREAS, Grantor has agreed to grant to Grantee, a permanent easement for ingress and <br /> <br />egress, and for such purposes consistent with the installation and maintenance of piping for the <br /> <br />purpose of establishing a private water distribution system over that tract of land described as <br /> <br />follows: <br /> <br />A fifteen-foot (15') strip lying on the outside perimeter of the <br />Property; <br /> <br />hereinafter referred to as "the Burdened Property". <br /> <br />WHEREAS, the parties wish to reduce their agreement to writing. <br /> <br />543713.1 <br /> <br />1 <br />
