June 16, 2022 <br />85 <br /> <br />Other tree species may be used, provided acceptable information is submitted to <br />indicate that the species are hardy street trees with a maturing height of thirty-five <br />(35) feet or greater; fast growing, short lived trees shall not be permitted. Smaller <br />trees, approved by the Planning Commission, will be permitted in areas with existing <br />overhead utilities. No one species shall comprise more than twenty- five (25) <br />percent of the entire number of trees in a particular development. <br />m. Trees shall be maintained and guaranteed for a minimum of two years. Planting of <br />trees shall occur within the standard planting season (May through November). <br />Acceptable stock will not have more than one-third (1/3) of the tree canopy <br />damaged or dead without replacement. Replacement trees shall conform to all <br />requirements of this section and shall be maintained and guaranteed for a minimum <br />of two planting seasons. <br />(aa) Parking Facilities for Mixed Use Developments. In Mixed-Use developments, or <br />developments where parking is affected by cooperative agreements between different <br />land uses, the applicant shall submit a parking demand analysis that demonstrates <br />parking demand patterns. The parking demand analysis must be approved by the <br />Planning Commission and will serve as the basis for determination of required parking at <br />the mixed-use site. <br />(bb) Shared Parking. The Commission encourages parking lots for different structures or <br />uses, or for mixed uses be shared. At the applicant’s request, shared parking may be <br />provided, subject to the following provisions: <br />1. A reciprocal written agreement has been executed by all the parties concerned that assures <br />the perpetual joint use of such common parking, a copy of which has been submitted to and <br />is acceptable to the Planning Commission and its legal counsel. <br />2. The Planning Commission may require the applicant to provide a parking study with all <br />information deemed necessary to its decision- making on a shared parking arrangement. <br />This information includes but is not limited to a) the type and hours of operation and <br />parking demand, for each use, b) a site plan displaying shared use spaces in the lot and <br />walking distance to the uses sharing the lot, c) a description of the character of land use and <br />parking patterns of adjacent land uses, and d) an estimate of anticipated turnover in parking <br />space use over the course of 12 (twelve) to 24 (twenty-four) hours at the site. <br />3. Parking spaces to be shared must not be reserved for individuals or groups on a twenty-four <br />(24) hour basis. <br />4. Uses sharing a parking facility do not need to be contained on the same lot, but each use <br />shall be a maximum of five hundred (500) feet from the closest parking space in the lot <br />providing the shared spaces. A variance of the maximum allowable distance between the <br />use and associated shared parking may be approved by the Commission with written <br />justification and supporting information provided by the applicant. <br />5. Uses sharing a parking facility shall provide for safe, convenient walking between uses and <br />parking, including safe, well-marked pedestrian crossings, signage, and adequate lighting.
