June 16, 2022 <br />141 <br /> <br />Article VIII. Traffic Impact Studies <br />Section 8.01 Purpose. Whenever a proposed project will generate one hundred (100) <br />new vehicle trips in the peak direction (inbound or outbound) during the site peak traffic <br />hour or seven hundred and fifty (750) daily trips, the applicant shall perform a traffic <br />impact study. Based on this study, certain improvements may be identified to provide <br />safe and efficient access to the development. <br />In addition, a traffic impact study shall be prepared if the following conditions exist within <br />the impact study area: <br />(a) Current traffic problems exist in the local area, such as a high-accident location, confusing <br />intersection, or a congested intersection which directly affects access to the <br />development. <br />(b) The ability of the existing, roadway system to handle increased traffic or the feasibility of <br />improving the roadway system to handle increased traffic is limited. <br />(c) The development includes the following: <br />1. Truck Stop <br />2. Hospital <br />3. High Schools <br />4. Elementary or middle schools over 600 students <br />5. Major recreation and entertainment facilities (indoor or outdoor) <br />6. Medical office building of 100,000 square feet or greater at build-out of all phases <br />7. General or corporate office building of 100,000 square feet or greater at build-out of all <br />phases <br />8. Retail or shopping center of 100,000 square feet or greater at build-out of all phases <br />Section 8.02 Traffic Impact Study <br />(a) Area of Traffic Impact Study. The traffic impact study area shall be based on the <br />characteristics of the surrounding area. The intersections to be included in the study shall <br />be adjacent to the site or have direct impact upon the access to the site. The <br />intersections shall be mutually agreed upon by the Cass County Engineer and the traffic <br />engineer preparing the study. The Planning Commission shall be called upon to resolve <br />any disputes between the county and the traffic engineer. <br />(b) Preparation by Transportation Engineer Required. Traffic impact studies shall be <br />prepared under the supervision of qualified and experienced transportation engineers <br />with specific training in traffic and transportation engineering and at least 2 years of <br />experience related to preparing traffic studies for existing or proposed developments. <br />(c) Horizon Year. The traffic forecasts shall be prepared for the anticipated opening year of <br />the development, assuming full buildout and occupancy. This year shall be referred to as <br />the horizon year in the remainder of this Ordinance.
