Improvement Construction Assurances <br />Section 7.01 Improvement Required. <br />(a) No project shall be considered in compliance with this Ordinance until the streets, street <br />signs, sidewalks and walkways, gutters and curbs within street rights-of-way, buffer <br />planting, shade trees, storm drainage facilities, sanitary sewer facilities, water supply <br />facilities, lot line markers, survey monuments, street trees, utilities and other <br />improvements as may be required have been installed in accordance with this Ordinance. <br />(b) During the course of these improvements and completion of the subdivision the <br />applicant shall be responsible for removal of all equipment, material and general <br />construction debris from the subdivision and from any lot, street, public way or property <br />therein or adjacent thereto. Dumping of such debris into sewers or onto adjacent <br />property is prohibited. <br />Section 7.02 Plan Improvements. <br />(a) Improvements Required. Except as provided in Section 7.03 of this Ordinance, no plat <br />shall be signed by the Board of County Commissioners for recording in the office of the <br />Cass County Recorder of Deeds unless all improvements required by this Ordinance have <br />been installed in accordance with this Ordinance. <br />(b) Improvement Construction. Upon approval of the Final Plat by the Board of County <br />Commissioners, the applicant may construct the required improvements shown on the <br />plan. The developer shall indicate the intent to construct the required improvements by <br />executing the applicable Memorandum of Understanding to be submitted at the time an <br />application is made for approval of a Final Plat by the Board of County Commissioners. <br />(c) Inspection of Required Improvements. As stipulated in the executed Memorandum of <br />Understanding, the County Engineer, or designee, shall be responsible for inspection and <br />approval of the required improvements. The engineer and developer shall agree upon a <br />notification procedure and a schedule of inspections to be made during construction and <br />upon completion of all improvements. <br />(d) Recording of Final Plat. Upon completion of the required improvements and notification <br />from the County Engineer that all improvements have been completed in accordance <br />with this Ordinance, the developer may proceed to record the Final Plat in the office of <br />the Cass County Recorder of Deeds in accordance with this Ordinance. The Final Plat shall <br />be recorded before the sale of any lots or the construction and occupancy of buildings <br />shown on the plats. <br />
