May 19, 2022 <br />6 <br /> <br />Section 2.02 County Planner <br />(a) There is hereby created the position of County Planner, who shall be a duly appointed <br />person charged with the administration, interpretation, and enforcement of this <br />Ordinance. <br />(b) The County Planner shall have the following duties: <br />1. Complete such activities as will assist the Board of County Commissioners and the Planning <br />Commission in fulfilling the duties established by this Ordinance <br />2. Complete research and prepare findings of fact pertaining to applications for plat approval <br />or other applications to be considered by the Planning Commission <br />3. Make determinations regarding the interpretation of this Ordinance when it becomes <br />necessary <br />4. Carry out such activities as may be necessary to assist in the enforcement of this Ordinance <br />5. Conduct such other business as may be authorized or directed by the Board of County <br />Commissioners or the Planning Commission <br />Section 2.03 Planning Commission <br />(a) The Planning Commission for Cass County shall be known as the “Cass County Planning <br />Commission” and may be referred to as the “Planning Commission.” <br />(b) The membership of the Planning Commission shall consist of nine (9) members <br />appointed by the Board of County Commissioners in a manner consistent with NDCC §11- <br />33.2-04, §11-33-04, and §11-33-05. <br />(c) The members of the Planning Commission may be compensated in a manner established <br />by the Board of County Commissioners and consistent with NDCC §11-33-05. <br />(d) The Planning Commission shall have the following duties: <br />1. Prepare proposed subdivision ordinance to be submitted to the Board of County <br />Commissioners <br />2. Prepare proposed subdivision ordinance amendments to be submitted to the Board of <br />County Commissioners <br />3. Prepare recommendations to be submitted to the Board of County Commissioners <br />pertaining to any proposed plat or other application which is presented for consideration <br />4. Conduct such other business as may be authorized or directed by the Board of County <br />Commissioners <br />Section 2.04 Appeals <br />(a) Any person, unit of government or agency may file an appeal when aggrieved by a <br />decision or interpretation by the County Planner, provided that the appeal is based on an <br />allegation that: <br />1. The County Planner made an error in the interpretation of this Ordinance, and <br />2. The erroneous interpretation specifically aggrieves the appellant. <br />(b) Application and Procedure. <br />1. A letter of appeal must be filed with the Finance Director within 30 days of the date of <br />written notice of interpretation or determination. The letter shall cite the decision made
