May 19, 2022 <br />51 <br /> <br />County staff shall have 7 days from the date of submission of an application to check the <br />documents to determine if on their face they are in proper form and contain all the <br />information required by this Ordinance. If defective, the application may be returned to <br />the applicant with a statement that the application is incomplete; otherwise the <br />application shall be deemed accepted as of the date of submission. <br />(m) Final Plat Review. Upon acceptance of a final plat application, the following steps will be <br />completed as part of the plat review process: <br />1. A copy of the completed application documents will be sent by certified mail to the relevant <br />township soliciting comments <br />2. Copies of the completed application documents will be distributed to each of the following, <br />when relevant, for review and comment: <br />a. Cass County Engineer <br />b. Cass County Planning Commissioners. <br />c. Water Resource District. <br />d. Electric company. <br />e. Telephone company. <br />f. Gas Company. <br />g. Cass Rural Water Users. <br />h. North Dakota Department of Transportation (if the subject site abuts a State road). <br />i. County Sanitarian. <br />j. Adjoining municipality (if site is located within one (1) mile of a municipal or ET <br />boundary). <br />3. The County will notify the applicant or representing agent and all land owners within a <br />minimum of 1,000 feet of the proposed final plat that the application is under review and <br />will be considered by the Planning Commission at a public hearing on a specified date. <br />4. The County Planner will schedule the Final Plat application for action at a regularly <br />scheduled public meeting within ninety (90) days of the first public meeting of the Planning <br />Commission after the date of filing. <br />5. The County Planner will prepare a report of findings pertaining to the consistency of the <br />proposed plat with this Ordinance and noting any comments or concerns raised by the <br />relevant township or other reviewing parties. <br />(n) Planning Commission Action. At a regularly scheduled Planning Commission meeting, <br />following the closure of the relevant public hearing, the Planning Commission shall <br />consider the reported findings and received public comment and shall make a <br />determination if the requested plat is consistent with this Ordinance. The Planning <br />Commission shall take an action to recommend denial of the application, approval of the <br />application, or approval of the application with conditions. <br />(o) Notification of Commission Action. Within fifteen (15) consecutive days after the meeting <br />at which the Final Plat application is reviewed, the county staff shall send written notice <br />of the Planning Commission’s action to the following: <br />6. Landowner or his agent. <br />7. Applicant.
