May 19, 2022 <br />45 <br /> <br />6. All vegetative buffer zones must be protected during development activities. Prior to the <br />initiation of development activities, ensure adequate visibility of the water quality buffer <br />zones by staking and flagging. Vegetative buffer zones, except vegetative buffer zones that <br />are completely within the limited or minimal disturbance zone setbacks, shall be surveyed <br />and iron pins set in the ground on side lots lines. <br />(j) Erosion and Sedimentation Requirements. <br />1. Purpose. In order to minimize erosion and sedimentation, certain requirements shall apply <br />to all sites disturbing one or more acres of land by grading or excavation. The following <br />standards are intended to ensure conformance with requirements established by the ND <br />Department of Environmental Quality. <br />2. No changes shall be made in the contour of the land; no grading, excavating, removal, or <br />destruction of topsoil, trees, or other vegetative cover of the land shall be commenced <br />within a proposed subdivision tract until such time that a plan for minimizing erosion and <br />sedimentation control has been reviewed by the Planning Commission and the County <br />Engineer. <br />3. The following measures are effective in minimizing erosion and sedimentation and shall be <br />included where applicable in the control plan using the ND Department of Transportation <br />Erosion and Sediment Control Handbook, as it presently exists or may hereafter be <br />amended. <br />a. Stripping of vegetation and grading shall be kept to a minimum; <br />b. Development plans shall preserve significant natural features, cut and fill operations <br />shall be kept to a minimum and plans shall conform with the topography so as to <br />create the least erosion potential and adequately handle the volume and velocity of <br />surface water runoff. <br />c. Whenever feasible, natural vegetation shall be retained, protected and <br />supplemented. <br />d. The disturbed area and the duration of exposure shall be kept to a practical <br />minimum. <br />e. Disturbed soils shall be stabilized by permanent vegetation and/or by engineered <br />erosion control and drainage measures as soon as practicable in the development <br />process. <br />f. Temporary vegetation and/or mulching shall be used to protect exposed critical <br />areas during development. <br />g. Provisions shall be made to effectively accommodate the increased runoff caused by <br />changed soil and surface conditions during and after development. Where <br />necessary the rate of surface water runoff will be mechanically retarded. <br />h. Sediment in the runoff water shall be trapped until the disturbed area is stabilized <br />by the use of debris basins, sediment basins, silt traps, or similar measures. <br />i. Basin and perimeter controls shall be established at the commencement of work on <br />the site. <br />j. Storage piles shall be protected and stabilized within thirty (30) days. <br />k. Earth or paved interceptors and diversions shall be installed at the top of cut or fill <br />slopes where there is a potential for erosive surface runoff.
