Alterations of vegetation and topography shall prevent <br />erosion into public waters, fix nutrients, preserve watercourse natural aesthetics, <br />preserve historic values, prevent bank slumping and protect fish and wildlife habitat. <br />Removal or alterations of vegetation is allowed according to the following <br />standards: <br />i. Intensive vegetation clearing shall not be allowed. <br />ii. Vegetation previously disturbed or disturbed during the construction of the <br />development or dwellings shall provide native riparian vegetation cover. <br />iii. Replacement of native riparian vegetation with non-native species shall not <br />be allowed. <br />iv. Limited clearing of trees and shrubs and cutting, pruning and trimming of <br />trees to accommodate the placement of stairways and landings, access <br />paths and watercraft access areas, as well as providing a view to the <br />watercourse from the principal dwelling unit or dwelling site, provided that: <br />1. The removal of vegetation shall be limited to a width less than six (6) <br />feet to provide the placement of a stairway or path access to <br />watercourse for residential lots. The removal of vegetation shall be <br />limited to a width less than ten (10) feet to provide the placement of a <br />stairway or path to provide access to watercourse for commercial <br />properties or public open-space recreational properties. <br />2. The removal of vegetation shall be limited to a width less than six (6) <br />feet for facilities such as ramps, lifts or mobility paths for physically <br />challenged to achieve watercourse access on residential lots. The <br />removal of vegetation shall be limited to a width less than ten (10) feet <br />for facilities such as ramps, lifts or mobility paths for physically <br />handicapped persons to achieve watercourse access for commercial <br />properties or public open-space recreational properties. <br />3. The removal of vegetation shall be limited to an area less than forty- <br />nine (49) square feet for stairway and lift landings on residential lots. <br />The removal of vegetation shall be limited to eighty-one (81) square <br />feet for landings used for commercial properties or public open-space <br />recreational properties. <br />4. Limited pruning of trees limbs to afford a view of the watercourse from <br />the principal dwelling unit or dwelling site shall be permitted and shall <br />be performed in conformance with good nursery and landscape <br />practices. The complete removal of trees or intensive vegetation <br />clearing to afford a view of the watercourse shall not be permitted. <br />5. The screening of structures, vehicles or other facilities as viewed from <br />the watercourse, assuming summer leaf-on conditions, is not <br />substantially reduced.
