May 19, 2022 <br />2 <br /> <br />Section 1.04 APPLICABILITY AND JURISDICTION <br />(a) This Ordinance applies to all lands over which the Cass County Board of County <br />Commissioners has jurisdiction under the constitution and laws of the State of North <br />Dakota and of the United States, except for land within the corporate limits of any <br />municipality or land within the area of application of extraterritorial zoning pursuant to <br />NDCC §40-47-01.1. <br />(b) This Ordinance applies to any person, partnership, corporation, or limited liability <br />company who or which being the owner or agent of any lot, tract, or parcel of land shall <br />lay out, construct, open, or dedicate any street, sanitary sewer, storm sewer, water main, <br />or other improvements for public use, travel or other purposes or for the common use of <br />occupants of buildings abutting thereon, or who or which sells, transfers, or agrees or <br />enters into an agreement to sell or transfer any land in a subdivision or engages in the <br />subdivision of land or erects any buildings thereon. <br />(c) This Ordinance shall not prohibit or prevent the use of land or buildings for farming or <br />any of the normal incidents of farming. <br />(d) A county auditor's plat made pursuant to NDCC §57- 02-39 is for taxation purposes for <br />convenience of tax officials in describing property on tax rolls and does not confer rights <br />in or transfer title to land. Such an auditor’s plat may only be initiated by a tax official of <br />Cass County. Thus, an Auditor's Lot is not approved by the County as an instrument for <br />the purposes of sale or development. <br /> <br />Section 1.05 COMPLIANCE <br />(a) No lot of record that did not exist on the effective date of this Ordinance shall be created, <br />by subdivision or any other mechanism, that does not conform to the applicable <br />requirements of this Ordinance. <br />(b) No access connection (new, changed, altered, re-constructed) including any field <br />entrance, driveway or public/private roadway (permanent, temporary or field <br />access/opening) onto a County highway or public right-of-way shall be permitted except <br />in accordance with the applicable regulations as set forth within this Ordinance. <br /> <br />
