Interpretation <br />Section 3.01 Liberal Interpretation to Further Underlying Purposes <br />(a) Interpretation and application of this Ordinance are the basic and minimum <br />requirements for the protection of public health, safety, comfort morals, convenience, <br />prosperity, and welfare. This Ordinance shall be liberally interpreted in order to further <br />its underlying purposes. The meaning of any and all words, terms, or phrases in this <br />Ordinance shall be construed in accordance with the following Rules and Definitions. <br />Section 3.02 Rules of Construction and Interpretation <br />(a) Words, phrases, and terms defined in this Ordinance shall be given the defined meaning <br />as set forth in the following text. <br />(b) Words, phrases, and terms not defined in this Ordinance shall be given their usual and <br />customary meanings except where the context clearly indicates a different meaning. <br />(c) The word “shall” is mandatory and not permissive; the word “may” is permissive and not <br />mandatory. <br />(d) Words used in the singular include the plural, and words used in the plural include the <br />singular. <br />(e) Words used in the present tense include the future tense, and words used in the future <br />tense include the present tense. <br />(f) In computing any period of time prescribed or allowed by this Ordinance, the day of the <br />notice or final application, after which the designated period of time begins to run, is not <br />to be included. Further, the last day is to be included unless it is not a working day, in <br />which event the period runs until the next working day. <br />(g) The word “person” indicates a corporation, a sole proprietorship, an unincorporated <br />association, a partnership, estate, or any other legally recognized entity, as well as an <br />individual. <br />(h) Within this Ordinance, sections prefaced “purpose” are intended to convey official <br />statements of legislative findings or purpose. These statements are intended to guide <br />the administration and interpretation of this Ordinance and shall be treated in the same <br />manner as other aspects of legislative history. However, they are not binding standards. <br />Section 3.03 Definitions <br />(a) The following words, unless the context otherwise requires, have the specific meaning <br />listed: <br />1. AADT. Annual average daily traffic count. <br />2. Abutting. To physically touch or border upon; or to share a common property line. <br />3. Access. A way or means of approach to provide physical entrance to a property. <br />4. Access Drive. A private drive providing vehicular access to and between parking areas for <br />more than two parking spaces within a subdivision; any drive servicing two or more units of <br />occupancy on a single lot.
