Mr. Benson said pursuant to the terms of the MOU, the next steps are to set a date and <br />time for a public hearing on the requests. He said once the public hearing is set, the Highway <br />Department will send notices of the public hearing to landowners within 1,000 feet of the closures at <br />least 30 days prior to the hearing. <br />Mr. Benson said he is requesting the Board set a public hearing for Monday, June 20, 2022, during <br />the regular meeting of the Board. He said following the public hearing, the Board will be asked to <br />approve a resolution taking over road ROW and granting permission to permanently obstruct the <br />same and the underlying section lines. <br />MOTION, passed <br />Mr. Peterson moved and Mr. Kapitan seconded to set a public hearing for June <br />20, 2022 during the regular meeting of the Cass County Board of <br />Commissioners for a resolution to take over road rights-of ways and grant <br />written permission to permanently obstruct the same of 24th Street Southeast, <br />27th Street Southeast, 170th Avenue Southeast, 171St Avenue Southeast, and <br />172"d Avenue Southeast in Harwood. On roll call vote, the motion carried <br />unanimously. <br />FM Diversion Closure Update <br />Assistant Cass County Engineer. Matthew Stamness was present and gave the Board a brief update <br />on road closures related to the Fargo-Moorhead Diversion project. He said 173" Avenue SE near <br />the Wild Rice Control structure was closed on April 28, 2022. Mr. Benson said 173' Ave SE was <br />approved for closure through the same process as the roads ROW public hearing that was set <br />today. <br />Mr. Stamness said the intersection of County Road 18 and County Road 81 is scheduled to be <br />closed on May 9 and due to weather may be pushed back to May 18. He said the groundbreaking <br />event had a date change and will now be held on August 9. <br />9. ROAD DEPARTMENT, Flood update <br />Mr. Benson said flood conditions in Cass County have been changing due to melting snow and rain <br />in area. He said he, Commissioner Steen, County Emergency Manager Jim Prochniak, County <br />Administrator Robert Wilson, and County Sheriff Jesse Jahner, met throughout the weekend to <br />monitor conditions and inform the media and public of changing conditions. He said on Friday night <br />and Saturday flood risks were increased and have seen a decline in the past 48 hours. <br />Mr. Benson reviewed flood levels throughout the County and how the levels have changed over the <br />past few days. The areas he reviewed include the Rush River at Amenia, Maple River near <br />Mapleton, Sheyenne River near Valley City and Lisbon, the Sheyenne River near Kindred, the <br />Sheyenne River near Harwood, and the Red River near Fargo. He said the Maple River near <br />Mapleton is seeing a decrease in crest levels which shows the benefits of the two Maple River <br />Dams. He said without the Dams, Mapleton would see a crest a foot or two higher which would be a <br />at record flood stage. He said the Sheyenne River near Kindred has had a slight decrease and will <br />crest on Friday or Saturday. He said impacts in the area will be in the City of Kindred and do not <br />have a large effect on County roads and bridges. <br />Mr. Benson said the Sheyenne River near Harwood has been another area of concern and the crest <br />height has decreased. He said the crest projection went from 91.5 feet to 90.0 feet and is projected <br />to crest in the next 24 to 48 hours. He said every inch makes a difference in overland flooding. He <br />said the Red River at Fargo was projected at a 28-foot crest and is now projected at a 26-foot crest <br />in the next few days. He said this drop allows more flow from the Sheyenne River into the Red River <br />which help reduce issues on the Sheyenne River.
