<br />Cass County Government - Tharaldson Ethanol <br />Contract for Financing of .Improvements to Cass County Highway <br />Number 23 from Interstate 94 Exit 328 to Cass County Highway 10. <br /> <br />lbis contract is between Cass County North Dakota hereinafter referred to as the County <br />and Tharaldson Ethanol, whose address is 1020 36lh Street SW, Fargo ND 58103 <br />hereinafter referred to as Tharaldson. <br /> <br />It is in the best interest of the Parties to have the County construct and maintain <br />improvements to the newly created Cass County Highway 23 according to the terms and <br />conditions set forth in this agreement. <br /> <br />The County will award a construction contract to construct the improvements to Cass <br />County Highway 23 substantially in accordance with the contract drawings for County <br />Project number CH0708 dated June 11,2007 entitled Gnlding, Concrete Surfacing, and <br />Incidentals Cass County 23; from Interstate 94 to Hwy 10. <br /> <br />The County will fund the Administration and Engineering Costs associated with the <br />project and $20,000 toward the construction costs. Cass County will add the highway to <br />the County Highway system and provide the necessary routine maintenanc,e induding but <br />not limited to snow removal, crack scaling, striping and minor pavement repairs. <br /> <br />It is anticipated that the North Dakota Department of Transportation will provide 90% of <br />the costs ofupg1"dding the railroad crossing including providing flashing signals and a <br />concrete crossing surface. Cass County will fund the local 10% portion of the crossing <br />upgrades. <br /> <br />In addition to the Rail Road Crossing funds, it is anticipated that the North Dakota <br />Department of Transportation will provide approximately $250,000 in Federal Funding <br />for the project. In the event that the N011h Dakota Department of Transportation provides <br />this funding to the County, this amount will be deducted from Theraldson's obligation. <br /> <br />The balance of the project costs is the obligation of Tharaldson. Bids for construction <br />were opened on June 28, 2007. The apparent low bid was received from ___ in the <br />amount of $ . It is anticipated that the actual construction cost will vary <br />slightly from the award amount due to quantity variations and unforeseen conditions. <br />Project costs to be paid by Tharaldson also include the land acquisition costs which are <br />estimated at $120,000. <br /> <br />Cass County will invoice Tharaldson for project costs as the costs are incurred. <br />Tharaldson will make payment within 15 days of receipt ofCass County's invoice. <br />
