COUNTY DEED

<br />This indenture made this 1st day of December, 2003, between the County of Cass,
<br />North Dakota, party of the first part, and Thomas D. Kennedy, 201 E Prairiewood Drive,
<br />Fargo, North Dakota, 58103, party of the second part, witnesseth:
<br />
<br />WHEREAS, the real property hereinafter described was acquired by the county through
<br />tax deed proceedings for the nonpayment of taxes levied and extended against said
<br />property for the years 1998 to 2002 inclusive, with interest and penalties, and an
<br />estimate of the 2003 taxes, amounting to the sum of One thousand two hundred fifty-
<br />eight and 88/100 ($1,258.88) dollars; WHEREAS, said real property was offered for
<br />sale, and sold, pursuant to authority to law, on the 18th day of November, 2003, and at
<br />said sale, said second party became the purchaser of the whole thereof, for the sum of
<br />Two thousand twenty-five and 00/100 ($2,025.00) dollars, which has been paid in full;
<br />
<br />NOW, THEREFORE, the said county as party of the first part, in consideration of the
<br />premises, and pursuant to authority of law, hereby assigns, that certain real property
<br />situated in Cass County, North Dakota, described as follows, to wit:
<br />
<br />That part of the Northwest Quarter (NW¼) of Section Nineteen (19), Township One Hundred Thirty-Eight
<br />(138) North, Range Fifty-four (54) West of the Fifth Principal Meridian, Cass County, North Dakota
<br />described as followed, Viz: Beginning at a point Nine (9) rods, Eight (8) feet and Six (6) inches East from
<br />the Northwest corner of said Northwest Quarter (NW¼) of Section Nineteen (19); thence East Six (6)
<br />rods; thence South Two hundred twelve (212) feet; thence West Six (6) rods; and thence North Two
<br />hundred twelve (212) feet to the place of beginning, said description being a portion of said Northwest
<br />Quarter (NW¼) of Section Nineteen (19) and now included within the corporate limits of the Village of
<br />Alice, Cass County, North Dakota; also known as Auditor's Lot One (1) of the NW¼ in Section Nineteen
<br />(19), Township One Hundred Thirty-Eight (138), Range Fifty-four (54).

<br />To have and to hold the above described real property with all of the appurtenances
<br />thereunto belonging to the said party of the second part, Thomas D. Kennedy, heirs and
<br />assigns forever.

<br />IN WITNESS WHEREOF Scott Wagner and Michael Montplaisir, as chairman of the
<br />board of county commissioners and county auditor, respectively, of said county, hereby
<br />do set their hands the day and year first above written and do cause the seal of said
<br />county to be affixed thereto.
