INTERGOVERNMENTAL SERVICE AGREEMENT (IGA) 07-01-07 to 06-30-09 CONTRACTOR: Cass County Jail Administrator Major Glenn D. Ellingsberg PO Box 488 Fargo, ND 58107-0488 PLACE OF PERFORMANCE: Same as Contractor EFFECTIVE DATES: 07-01-07 to 06-30-09 RATE FOR SERVICES: $60 per person-day This contract applies to only Parole Violators under supervision of the Adult Services Division of the North Dakota Department of Corrections and Rehabilitation. ARTICLE I - PURPOSE of IGA The state of North Dakota, by and through its Department of Corrections and Rehabilitation ("DOCR") and the Contractor, agree that the Contractor shall undertake the custody, care, and treatment of offenders sentenced to the legal and physical custody of the DOCR at the request of the DOCR in order that the DOCR be able to more effectively manage its incarcerated offender population. ARTICLE II - AUTHORITY This IGA is entered into pursuant to Chapters 12-44.1, 12-47, and 54-23.3 of the North Dakota Century Code. ARTICLE III - SUPPORT AND MEDICAL SERVICES The Contractor agrees to accept and provide for the custody, care, and safekeeping of offenders sentenced to the legal and physical custody of the DOCR, including parole violators, in accordance with applicable federal, state and local laws, standards, policies, procedures, or court orders applicable to the operations of the facility. The daily rate for services includes the cost of routine medical care per offender up to $150 per month. Routine medical care includes non-prescription and prescription medication, and non-emergency medical, dental, or optical care that may be provided locally. The Contractor may bill the DOCR for medical expenses in excess of $150.00 per month in accordance with this section and with Article VIII of this Agreement. The DOCR shall pay for necessary medical treatment required for DOCR offenders in excess of $150.00 per month under the following conditions: (1) Medical services must have prior approval from DOCR Adult Services Division Medical Director Kathleen Bachmeier (701-328-:6232); , , "', (2) The Contractor must utilize medical service providers that accept Medicaid as the sole source of payment.
