<br />INTERGOVERNMENTAL SERVICE AGREEMENT (IGA) <br /> <br />07-01-07 to 06-30-09 <br /> <br />CONTRACTOR: <br /> <br />Cass County Jail Administrator <br />Major Glenn D. Ellingsberg <br />PO Box 488 <br />Fargo, ND 58107-0488 <br /> <br />PLACE OF PERFORMANCE: <br />Same as Contractor <br /> <br />EFFECTIVE DATES: 07-01-07 to 06-30-09 <br /> <br />RATE FOR SERVICES: $60 per person-day <br /> <br />This contract applies to only Parole Violators under supervision of the Adult Services <br />Division of the North Dakota Department of Corrections and Rehabilitation. <br /> <br />ARTICLE I - PURPOSE of IGA <br /> <br />The state of North Dakota, by and through its Department of Corrections and Rehabilitation <br />("DOCR") and the Contractor, agree that the Contractor shall undertake the custody, care, and <br />treatment of offenders sentenced to the legal and physical custody of the DOCR at the <br />request of the DOCR in order that the DOCR be able to more effectively manage its <br />incarcerated offender population. <br /> <br />ARTICLE II - AUTHORITY <br /> <br />This IGA is entered into pursuant to Chapters 12-44.1, 12-47, and 54-23.3 of the North Dakota <br />Century Code. <br /> <br />ARTICLE III - SUPPORT AND MEDICAL SERVICES <br /> <br />The Contractor agrees to accept and provide for the custody, care, and safekeeping of <br />offenders sentenced to the legal and physical custody of the DOCR, including parole violators, <br />in accordance with applicable federal, state and local laws, standards, policies, procedures, or <br />court orders applicable to the operations of the facility. <br /> <br />The daily rate for services includes the cost of routine medical care per offender up to $150 <br />per month. Routine medical care includes non-prescription and prescription medication, and <br />non-emergency medical, dental, or optical care that may be provided locally. The Contractor <br />may bill the DOCR for medical expenses in excess of $150.00 per month in accordance with <br />this section and with Article VIII of this Agreement. <br /> <br />The DOCR shall pay for necessary medical treatment required for DOCR offenders in excess <br />of $150.00 per month under the following conditions: <br /> <br />(1) Medical services must have prior approval from DOCR Adult Services Division <br />Medical Director Kathleen Bachmeier (701-328-:6232); , , "', <br /> <br />(2) The Contractor must utilize medical service providers that accept <br />Medicaid as the sole source of payment. <br />
