Writing out the procedure helps ensure that fairness. <br />• The draft procedures for variances are lengthy, and involve two hearings (one at the planning <br />commission and one at the board of county commissioners meetings). Is it legal to only hold the <br />hearing at the planning commission meeting and have the Board of County Commissioners <br />agree or disagree with the planning commission recommendation. <br />• The draft ordinance establishes criteria which must be considered for approval of a variance. <br />The NDCC doesn’t spell out this kind of detail. Is there any legal reason why the ordinance <br />cannot establish criteria for approval? <br />• What is the minimum amount of notice that should be used for variances? Does it need to be all <br />property owners withing a mile as the draft ordinance establishes? Could it be just to the <br />applicant?
