Deed Restriction Fact Sheet <br />Ms. Puppe discussed the new Deed Restriction FAQ document. Mr. Gust expressed appreciation to have <br />such a document that would help clear up any confusion on deed restrictions. <br /> <br />Information – Affidavit <br />Ms. Puppe described the affidavit. It will set up notification system for the Planning Department to be <br />notified of recordings. It is way to help control further development after an Auditor’s Lot Plat is <br />recorded. After receiving an initial notice of a violation of the Cass County Subdivision Ordinance, if the <br />property continues to be in violation, this affidavit would be recorded against the property to show that <br />it is not in compliance with the Cass County Subdivision Ordinance. This affidavit would come from the <br />Cass County Planner and would be a way to limit further splitting of property. Once a plat is recorded in <br />compliance with the Subdivision Ordinance, the affidavit would be removed or deemed ineffective. <br /> <br />Information/Update – Subdivision Ordinance <br />Included as the major subdivision section. January 27, 2022 meeting will include a cleaned up copy. <br /> <br />G. OLD BUSINESS <br />Open Planning Commission position – there has been one applicant so far. <br /> <br />H.
