BEFORE THE CITY COUNCIL, CITY OF ARGUSVILLE, STATE OF NORTH DAKOTA <br /> <br /> <br />In the Matter of the Unsafe, Dangerous, ) <br />and Dilapidated Structure(s) Located ) FINDINGS OF FACT <br />on Lots 7-12 and 13-24, Block 9, Original ) <br />Townsite to the City of Argusville, North Dakota ) AND ORDER <br /> ) <br />-------------------------------------------------------------- <br />FINDINGS OF FACT <br /> 1. James E. and Deborah K Baumler (the “Baumlers”) are the owners of the <br />property located on Lots 7-12 and 13-24, Block 9, Original Townsite to the City of Argusville, <br />parcel numbers 09-0100-11883-000 and 09-0100-11882-000, located within the city limits of <br />the City of Argusville, Cass County, North Dakota. <br /> 2. Building inspector Christine Rose inspected the above-referenced building(s) and <br />on or about September 28, 2017, issued a report of her findings. <br /> 3. On or about September 29, 2017, Ms. Rose issued a Notice of Dangerous <br />Building stating that as a result of her inspection, she (Ms. Rose) had determined the building(s) <br />and structure(s) located on Lots 7-12 and 13-24, Block 9, Original Townsite to the City of <br />Argusville, parcel numbers 09-0100-11883-000 and 09-0100-11882-000, located within the city <br />limits of the City of Argusville, North Dakota, to be a dangerous building(s), and nuisance as <br />defined by the Argusville City Ordinances. In particular, Ms. Rose found that the building(s) on <br />the property is found to have a collapsed roof on the southern portion of the building, windows <br />covered in plywood, and the exterior of the building was failing. Accordingly, Ms. Rose notified <br />the Baumlers that the building(s) constituted a dangerous building(s) because 1) the building(s) <br />shows thirty-three percent or more of damage or deterioration of the supporting member or
