32 <br /> <br />3) The County will notify the applicant or representing agent and all land owners within a <br />minimum of 1,000 feet of the proposed final plat that the application is under review and will <br />be considered by the Planning Commission at a public hearing on a specified date. <br />4) The County Planner will schedule the Final Plat application for action at a regularly scheduled <br />public meeting within ninety (90) days of the first public meeting of the Planning Commission <br />after the date of filing. <br />5) The County Planner will prepare a report of findings pertaining to the consistency of the <br />proposed plat with this Ordinance and noting any comments or concerns raised by the <br />relevant township or other reviewing parties. <br />(d) Planning Commission Action. At a regularly schedule Planning Commission meeting, <br />following the closure of the relevant public hearing, the Planning Commission shall <br />consider the reported findings and received public comment and shall make a <br />determination if the requested plat is consistent with this Ordinance. The Planning <br />Commission shall take an action to recommend denial of the application, approval of the <br />application, or approval of the application with conditions. <br />(e) Notification of Commission Action. Within fifteen (15) consecutive days after the meeting <br />at which the Final Plat application is reviewed, the county staff shall send written notice <br />of the Planning Commission’s action to the following: <br />1) Landowner or his agent. <br />2) Applicant. <br />3) Firm that prepared the plan. <br />4) Township Chairman. <br />(f) If the application is disapproved, the staff will notify the above individuals, in writing, of <br />the defects in the application and will identify the requirements which have not been <br />met; citing the provisions of the statute or ordinance relied upon. <br />(g) Compliance with Planning Commission Action. If the Planning Commission conditions its <br />Final Plat approval upon receipt of additional information, changes and/or notifications, <br />such data shall be submitted and/or alterations noted on two (2) copies of the Plan to be <br />submitted to the county staff for approval. <br />(h) Board of County Commissioners Action. No plat shall be finally approved or disapproved <br />by the Board of County Commissioners until the following has been met: <br />1) Receipt of recommendation by the Planning Commission. The recommendations by the <br />Planning Commission shall not be binding on the Board of County Commissioners. <br />2) Receipt of written recommendation by the board of township supervisors of the township in <br />which the proposed subdivision is located or more than 60 days have lapsed since <br />notification to the relevant township without receipt of a recommendation by the board of <br />township supervisors. If no written recommendation was received within the 60 period, the <br />Board of County Commissioners may take action on the final plat. The recommendations of <br />the board of township supervisors shall not be binding on the Board of County <br />Commissioners.
