7.9 Gender. Where the context of the Agreen)ent requires, the singular shall include the plural and vice versa, and the masculine gende~ shall include the feminine. 7.10 Amendments. This Agreement may be mended at any time only upon written agreement between the Employer and DBI. 7.11 Notice. DBI shall not be bound by any communication until it has been received at its office at 203 North 10th Street, Fargo, ND 58102 or at such other address as it has specified to the Employer. The Employer shall not be bound by any communication until it has been received at the address shown below or such other address as it has specified by Employer to DBI. 7.12 Unenforceability Provision. If any provisioni of this Agreement is found to be unenforceable, the Agreement's unaffected provisions ,~will remain in effect and the parties will negotiate a mutually acceptable replacement iprov~s~on consistent with the parties' original intent. 7.13 Assignment. Neither party may assign any o~ its fights, this Agreement or delegate any of its obligations without the prior written consent of the other party. 7.14 Waiver. If either party fails to enforce any fight or remedy under this Agreement, that failure is not a waiver of the fight or remed3~ for any other breach or failure by the other party. This Agreement, including any attachments or other exhibits, is accepted and agreed to by the parties as of the date specified below.
