I note that in ~13 they are making couple of changes. (1) They are removing the term attorney fees, implying that the County may not collect attorney fees as one of its remedies. As a general rule attorneys fees are not collected except in special circumstances which probably would not arise herein. So, in a sense, it is limiting our remedies. On the other hand, given the nature of the lessee, this is not likely a large concern for us. (2) They are also modifying the word "arise" to "be awarded". In the "arise" context, they could be concerned the County could collect the costs/disbursements even if the a court did not award them. As amended a court would have to award them before the County could collect.
